2. Snow Angel Application - Service Request

   In order to determine whether the services offered by the Snow Angel Program will be suitable, please be aware of the following information: 

   Scope of Service: The Snow Angel program is designed to provide assistance in clearing snow from adjacent City sidewalks for registered owners or occupants of private property that qualify to participate in the program. Volunteers will not clear driveways, private walkways, stairs, porches, or any part of the property other than the designated sidewalk.

   Volunteer-Delivered Service: Snow removal is performed by volunteers registered and trained by the City of Nelson. Volunteers may only perform tasks they have been trained and authorized to perform. There is no fee for this service.

   No Guarantee of Service: The Snow Angel Program cannot guarantee that volunteers will be available following a snowfall. The City cannot predict weather severity, volunteer availability, or the number of eligible participants. If timely snow removal is essential, applicants should consider arranging alternative or paid snow-removal services.

   Safety & Hazard Notice: Snow and ice removal involves inherent risks. Volunteers may use shovels, pushers, or similar hand tools and may apply sand or salt at their discretion. The City does not control surface conditions on private property and makes no representations regarding safety conditions.

   Collection of Personal Information: Information collected is used to determine eligibility and coordinate services under the Snow Angel Program. Your information is managed in accordance with the Freedom of Information and Protection of Privacy Act.

29. RELEASE & INDEMNITY AGREEMENT

    To: The City of Nelson, and its agents, employees, servants, officers, volunteers, directors, licensees, invitees, and those from whom it is in law responsible (collectively, the "City")

    WHEREAS the Participant is responsible for the removal of snow from the sidewalks adjacent to the property located at (the “Property”), AND WHEREAS the Participant wishes to participate in the Snow Angel program (the “Program”) through which volunteer Snow Angels may assist with clearing snow from sidewalks adjacent to the Property;

    AND WHEREAS participation in the Program is voluntary, not guaranteed, and dependent on the availability, capacity, and discretion of the City and volunteers;

    NOW THEREFORE, in consideration of the Participant being permitted to participate in the Program, the Participant agrees as follows:

    1. Volunteer Interaction and Boundaries: The Participant acknowledges that interaction with Snow Angel volunteers is limited to what is necessary to perform sidewalk snow removal. Volunteers are not permitted to enter the home or any structure on the Property.

    2. Property Responsibility and Bylaws: The Participant acknowledges that they, the owner(s) or occupant(s) of the Property, remain solely responsibility for compliance with all applicable municipal bylaws, including Nelson City Traffic Bylaw NO. 3156, and for maintaining the safety and condition of the Property, including sidewalks, yard areas, and all exterior and interior structures. The City does not assume responsibility for maintaining the Property nor guarantee its safety.

    3. Acknowledgement of Risks: The Participant understands that snow removal involves inherent risks, including slips, falls, and injuries. The Participant acknowledges that the city cannot predict or control weather conditions, surface hazards, volunteer actions, or volunteer availability.

    4. Limitation of Liability: The City will not be liable for any damage, loss, theft, property damage, or bodily injury (including death), whether direct or indirect, arising from Participation in the Program or from snow removal activities performed (or not performed) by volunteers.

    5. Indemnification: The Participant agrees to indemnify and hold harmless the City from all claims, actions, damages, losses, liabilities and expenses (including legal fees) arising in connection with participation in the Program or services provided by volunteers.

    6. No Guarantee of Services: The Participant understands and agrees that the City is not responsible for any injury, damage, or loss resulting form snow or ice not removed because volunteers were unavailable, unable to attend, or declined to attend.

    7. Binding Effect: This Release and Indemnity is effective and binding upon the Participant and their heirs, next of kin, executors, administrators, and assigns.
